The Website is operated by 3xD Design, a sole proprietorship based in Brantford, Ontario, Canada ("3xD Design", "we", "us", "our"). These Terms contain important information about your rights and our limitations of liability. Your access to and use of the Website is conditional upon your acceptance of and compliance with these Terms. The Website is provided for general informational and marketing purposes. It describes the services 3xD Design offers, including web design, web development, e‑commerce, AI and automation, and ongoing support and maintenance.

Information on the Website is not an offer, quote, or commitment to provide services, and your use of the Website does not by itself create any client, advisory, or contractual relationship between you and 3xD Design. Any engagement for paid services is governed by a separate written agreement (such as a proposal, statement of work, or services agreement) entered into between you and 3xD Design. In the event of a conflict between these Terms and such a separate agreement with respect to that engagement, the separate agreement controls.

You agree to use the Website in accordance with all applicable laws, rules and regulations and these Terms at all times. The following is a non‑exhaustive list of prohibited uses of the Website. You agree that you will not:

  • Impersonate or attempt to impersonate 3xD Design, its owner, or any of its representatives, contractors or affiliates;
  • Misrepresent your identity or your affiliation with any person or entity;
  • Send or attempt to send any advertising or promotional material, including spam, junk mail, chain mail or any similar material;
  • Engage in any conduct that restricts or inhibits any other person's use or enjoyment of the Website, or that, as determined in our sole discretion, may harm us or other users or expose us or other users to liability;
  • Use the Website in any manner that could disable, overburden, damage or impair it, or interfere with any other party's use of the Website;
  • Use any robot, spider, scraper or other automated technology, process or means to access, monitor or copy any material on the Website for any purpose without our prior written permission;

To the fullest extent permitted by applicable law, the total aggregate liability of 3xD Design arising out of or relating to the Website, whether arising from breach of contract, tort (including negligence) or otherwise, shall be limited to the amount of fees, if any, actually received by 3xD Design from you in connection with the Website.

This limitation of liability reflects the allocation of risk between you and us. The limitations in this section will survive and apply even if any limited remedy in these Terms is found to have failed of its essential purpose, and inure to the benefit of 3xD Design. Reporting claimed infringement

These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. Any dispute, controversy or claim arising out of or relating to these Terms or the Website, including the interpretation or breach thereof, shall be subject to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada, and you consent to the personal jurisdiction of those courts.
